Justin Wiater

Attorney Justin Wiater is a seasoned trial lawyer with more than two decades of courtroom experience. A native of Wheeling, West Virginia, Justin has built his career on advocating for clients both in private practice and in public service.

Justin earned his B.A. in History from Ohio University in 2000 and his J.D. from Capital University School of Law in 2003. While in law school, he externed with the Honorable Edmund Sargus, United States District Judge for the Southern District of Ohio, gaining early exposure to complex federal litigation.

Justin began his legal career as a criminal defense attorney in Columbus, Ohio, and later with the Public Defender Corporation for the First Judicial Circuit of West Virginia. During this time, he tried more than 15 jury trials, sharpening his skills as a courtroom advocate. In 2005, he was part of a federal defense team in a high-profile insider trading, conspiracy, and obstruction of justice case tried in the Southern District of Ohio. After five weeks of trial, his team secured not guilty verdicts on all 12 counts for both of their clients—an extraordinary result in a complex federal prosecution.

In 2013, Justin joined the Fitzsimmons Law Firm PLLC, where he concentrated his practice on personal injury, car and motorcycle accidents, and premises liability claims. After a decade with the firm, he went on to serve as a Hancock County Prosecutor, gaining valuable perspective from the other side of the courtroom before returning to private practice.

In July 2025, Justin joined Polverini and Wiater, PLLC as a partner. Today, he focuses his practice on personal injury litigation, bringing a unique combination of trial experience, prosecutorial insight, and client-centered advocacy to every case.

When he’s not in the courtroom, Justin enjoys playing golf at Oglebay Park and lacing up for ice hockey in the WAHA senior league.
